I was with ATT and have been assimilated by Cingular. Somehow they took away the minutes I had with my AT&T plan and said it never existed and that all along I have only had 400 minutes for 39.95. Of course I don't have paper work to back me up but we originally because of a corporate rate had 750 minutes for 39.95. I don't know what happened but I know they did something and I want out. Preferably without paying the $175.00 to cancel.

It sounds like you're going to have to find some paper. There may be a snowball's chance that you may be able to see your old plan when you log onto your account at the site, but that's unlikely.
Now I'll have to check mine! In my case, a new plan would improve my rate, but I've already decided to look for a new provider, as Cingular failed to provide timely information on changing plans and hardware.
I recommend that you write a letter - email or paper - to every corporate address you can locate for ATT. I received at least two personal responses from ATT execs from my first letter (tho' they couldn't do anything, since the site migration was simply not done yet). Starting and following up on these communications can provide a path of travel for resolving your problem. Be ready, though, to stay with them throughout the contract period if they restore the plan you originally bought.
Lastly, you might try a guerilla tactic: if you can sign up for automatic payment via a credit card, you can then complain to your bank that Cingular switched plans on you. It'll go into dispute (for a month or two), and you might just get it resolved without having to fight hard at all.
Good luck with it, and post your results!

does the bank thing really work? Sounds like a way of getting your bank to do the disputing with someone they have nothing to do with (especially when they call to dispute, and the notes on the account state you called in to dispute before you signed up for auto pay).
Lol, it sounds like for some reason, you were on a local plan (750 mins), is there a way you might have gotten the national plan (450 mins).
The national plan has covers roaming and longdistance across the US, while the local plan has a much smaller calling area. They're both the same price, sometimes when service is set up the store rep will put the wrong plan into the computer, however Care will usually fix this with a customer, if they haven't been on the plan for more than 60 days.
Its usually a good rule of thumb to call in and verify what plan your on when you start service. Plus, care can tell u about any (if any) promotions that were added to the account at the point of sale, and what contract terms were placed. It will confirm with you, the customer, that they have the service you wanted in place.
Also, I would advise calling in again, so you can get this dispute resolved, I mean, if there was a change in the past 6 months they can pull your bill to see what plan you had.

As I was told by Cingular, my agreement was with ATT and I had no contract with Cingular. I do not like Cingular because of their limited coverage (Strictly GSM) so I did not move my account over to them but cancelled my ATT account and went with Verizon. If Cingular persists in saying you have a contract with them ask them where your rollover minutes are and to send you a copy of your agreement with them.

it sounds and looks like you promotions for your TDMA (older digital service) had an end date or were never added in the first place....call National Business Services (they handle the corporate accounts) at (800) 999-5445... if its supposed to be there they will put it there and credit accordingly

no... they will make it seem like you have to migrate... but you dont have to... as long as you have a working phone you can keep your current rate plan and promotions... you can renew your contract (probabaly be sent of to the loyalty department) be specific with the representative and ensure you stay on the same rate plan title... before he/she makes the changes have the rep review the changes...and ask for a confirmation letter....then you have it in writing review again when you recieve the letter....

From my experience, Cingular should leave your existing plan alone until you want a new phone or plan. My own contract expired well over a year ago, and there have been no changes. There are two views of the whole megilla here:
Theirs: Cingular is kind enough to take over your ATT account, but will make no changes unless you move to a Cingular plan, which will probably require a new handset.
Yours: You are kind enough to allow Cingular to serve you until you decide to make a change.
Theoretically, Cingular can simply drop you at any time - but they won't, because they can't afford to fail with this integration. They're currently at the short end of the stick, and are being said to bend over backwards to keep business.
Bottom line: You should be able to keep your good deal until further notice - which may or may not come.
