On Sept 15th of 2004 I stopped by a T-Mobile Kiosk and the salesman talked me into trying a phone even though I told him I'd get no service at my house. I only gave him my street address because I thought he was looking at coverage and didn't expect any mail from T-Mobile. So I signed the contract (I was actually hoping that I'd get service at my house) and he told me to bring the phone back if it didn't work and there would be no charges. So of course there was no service at my house nor 25 miles FROM my house. So I took the phone back to him on Sept. 18th. He got on the phone at the kiosk and I assume was cancelling my service. He then put the phone under the counter and said NO CHARGE. I thought nothing more of the phone or anything.
Then, 6 months later I get a call from a collection agency that said I owed T-Mobile $367.69. $200 was an early de activation fee. I told them I only had the phone for 3 days and didn't even USE it. So, they told me to write a letter of dispute and fax it to them. So, I'm doing that today. But what I've been reading on this site and others about disputes with T-Mobile does NOT look good for me.
Is there anything else I can do to help myself not have to pay this bill? Anything besides sending this letter of dispute? I'm so afraid T-Mobile is going to say "Pay it anyways". But I didn't even USE the phone or have it in my possession for more then 3 days. The Salesman never told me I had to call or write anyone to cancel service...I assumed he did it all.
Anyone have any advice for me?

Fax your information into the customer relations department. It will look pretty funny that you have only used the phone for 3 days out of 6 months lol. Go back to the dealer get his information file a complaint (you can do this through Customer Care> Commision Fraud) The dealer should have adv customer care that you were cancelling because you were still within your buyers remorse and customer care would need him to call and say that you returned the equiptment. Did you not receive a Bill from Tmobile for the entire 6 months that you were suppose to be with them??? call in and verify your address for them, see if your address matches the one on file.

That was part of the problem, they didn't have my mailing address, only my street address. I didn't ever expect mail from T-Mobile. They were getting the bills back but never called me for the right address.
Where do I find Customer Care>Commission Fraud?
I plan on going to the Kiosk today to get my original reciepts to send with my letter of dispute.

Oh no you file a complaint through Customer Care under the reason commission fraud. The dealer didnt cancel your line because he would have lost his commission. Just get the dealers name, dealer code and store name. Should be on your original invoice.

Do you still have a copy of the contract? Was there any usage on your line? If there has been no usage or very little use, you may have a good chance of disputing the charges. Tmobile sends out bills though. Didnt you get bills or collection notices advising you that you were still being charged? Do you have the Dealers information who took your phone back? I would also advise you to contact the store manager and advise him/her of the issue. Also, dispute the issue with them. Was it an INDIRECT DEALER (a store who sells every thing)? Also, if you still have the contract, check to see if there is an IMEI (the phones serial #), this may help prove that your phone was basically stolen. Keep disputing, and present them with evidence....

I did not recieve any bills in the mail because they didn't have my mailing address. I went to the Kiosk today and got the print out of the original reciepts from when I got the phone and when I took the phone back. The phone was never used. I faxed all of this to the collection agency.
I did call Customer Care and tried to get info on filling a complaint, the guy was very nice and really tried to help me. Said he can't do much since it's already in collections but if the Collection company can't resolve the issue then he said to call the customer care back and they can help and take it to headquarters. That made me feel a lot better.
So, now I just wait.

I would FAX EVERYTHING TO Tmobile Customer Relations department. I think this is the number 505 998 3796, you may want to call customer care to verify that. Let me know how it works out. If you cant get it resolved in 72 hours after faxing Customer Relations I have the number for the T-Mobile Corporate Office in Bellevue. Im sure Customer Relations will help you out though good luck!!!

samsung, bellevue is the legal dept, and you might not want to be so eager to share that (and i quote) 'confidential, proprietary information' especially in light of the current uproar over paris hilton's sidekick bullshit.
just a friendly suggestion, i dont want to see good people get in lots of trouble for just trying to help people
