I m a victim of this m-m case too.

This is the contract agreement from Cingular wireless

http://www.bellsouth.com/ic/html/pop/cingular_tc.html

no where its mentioned about the way m-m works during nights and weekends.
Apart from this , I have called up many times to verify this with customer service and I had been getting wrong answers that "m-m is unlimited irrespective of the time of call"
This indeed is a huge huge plunder and loot.
The term "Unlimited m-m" is completely misleading and wrong. It applies only for plans which have unlimited nights and weekends.

if you make a call during the night or weekend time (off peak) the airtime goes to your N&W bucket... M2M calls are peak calls only... both buckets are unlimited

the technical term for this called draw down order....

examples...

you call from your cel to another cing cel.. its noon on a tuesday....you talk for 5 minutes... that call appears as a MTM call

you call the same phone at noon on a saturday... it goes to your N&W minutes...

and your assumtion of MTM and N&W is incorrect...

39.99 plan is 5000 N&W with unlimited 2M... look at cinglar.com for a reference...

what it says in that T&C is

"Unlimited night and weekend minutes are only available on Cingular plans starting at $49.99 per month"

that statement is correct... you conclusion is wrong

Enough with all these hidden meaning about unlimited m-2-m. Just go online and read under 'plan terms' which in NO way has defined clearly the term and definition for M-2-M unlimited feature, nor was it mentioned under its advertising brochure. Under the plan terms, it covered all issues in details specifically from minute increment billing and usage, pricing/txes/no proration (remember AT&T lost the lawsuit for mishandling the proration issues), Nights and weekends definition, Mobile to mobile minutes etc., but nothing was specifically addressed on m2m restriction, on the other hand, m2m was advertised with rest of other plans as UNLIMITED nationwide calling to over 50 million cingular customer!!

I don't care how you want to present the order of minutes usage on 1.n/w 2. m-2-m 3. day tme sequence, perhaps I dont have the intelligence to decipher the code that you expect general public to understand. All I know is I follow the plan and terms, following all the fonts on Cingular official website & official bronchure and no where did it mention about unlimited m-2-m is only limited to on-peak period. I have spoke to two Cingular Wireless agents, both of them were not aware of the Unlimited M-2-M was only restricted to on-peak. Furthermore, the Cingular salesrep was not aware of the restriction, not to the best of his knowledge. If there are restrcitions to m-2-m, then it shouldn't be called 'Unlimited', should it? why sell the gimmick? Perhaps they should address it more clearly on the advertisement and mention it on the Plan Terms. Remember block buster was sued for misleading their customers on their advertisement recently?

I'm a physician at University of Pennsylvania, and I'm two blocks away from my buddies at University of Pennsylvania Law School. Go ahead insult my intelligence all you want. I will bring this matter to a higher level of justice and for those people who felt have been misled by Cingular, like Chery, babysammi, etc. please contact me. Enough is enough

ps Since this might involve a legal issue, i suggest those people who trolls or who enjoys adding unproductive comment do not reply. because all you do is just adding your name to this case. I thank you for your coorperation.

well if yall are useing more than 5k n&w you NEED to step up to a unlimited n&w plan ensted of bitching every month about a 500 dollar bill spend the extra 20 a month and get the higher plan, or heres a bright idea USE YOUR HOME PHONE, another thing it states in cingulars t&c is that cell phones are not intended for dayly usage business or emergencies

I feel horrible for all these people. At least I know now, that Its not just me. I have a $2000+ cell phone bill that was accumilated over a one month span. HOW ? All I wanted to do was see the bill. Till this day I have yet to see it. 6 months in counting. Apparently when i switched to the GSM ( what ever the hell it is called network) they put me on a basic plan. When I wanted to be assured that My plan wasnt going to change since it took a while to establish a good plane rate. Which was stable in price. I was assurec that things would be the same just a different network. However, they didnt tell me that my mobile to mobile, my free nights and weekends were taken away. When i asked for bills to be sent to my new address. they wouldnt let me change it cause they messed up my SS#. Which I got the run around and had to go downtown to a corporate office to have fixed. Thats just the beginning.......6 months later Im still spending 1hr 45 min on the phone with them.

I see your research is lacking doc....

at the website...in the common questions area
quite clearly defined

How do I use the Mobile to Mobile feature?

---------------------------------------------------------------------- ----------
A:
Use of the Mobile to Mobile feature is automatic when you place and receive calls to and from other Cingular phones in your Mobile to Mobile calling area. If you are not sure of your Mobile to Mobile calling area, please call us at 1-866-CINGULAR.

Mobile to Mobile minutes do not roll over, and are not available with all rate plans. A call will only be rated as Mobile to Mobile if the caller and the receiving party are both on the Cingular network, using Cingular phones, and in the Cingular Mobile to Mobile calling area. If your phone displays "Cingular Extend" while in the Mobile to Mobile calling area, the call will not be rated as Mobile to Mobile.

Thank you for your bringing the definition of 'mobile to mobile minutes'. While you're defining the mobile to mobile minutes plan, you are not exactly answering to my previous post. Please re-read my post before you attempt to defend the conundrum of Cingular Ad. My point of post was directly converging on the enigmatic meaning of 'Unlimited Minute to Minute plan' which was printed in bold letters on their ad.

If you can research and come up with a well-defined term for 'Unlimited Minute to Minute', that will be alot more helpful than defining other terms of irrelevance.'
