Thanks for your reply. I filed a full report went to local and county courts. I know who had my phone, we have a warrant out for his arrest, since he did not appear in court. That is of little help. TMobile has not budged 1 dollar on what I owe them. TMobible actually did give me 60 days to work it out but time is running out and this will go to my credit report, which will cost me more pain and money in higher loans and actually TMobile even used the police report against me to say see it is my responsibility. (I lent the phone to an employee) Which gets me to the simplist of points. There was even a 208 minute conference call I called the person and they did not cooperate I threatened them with a lawsuit that didn't help. I told TMobile to go after this person they know something, they told me they can't help. Why do they want a report if it doesn't help. If I would have known for one second that I had this inter. dialing I would have barred it in one second. All the other issues to me are not important, they have a feature activated that is not mentioned in their contract or terms. They have a feature that is hardly used, yet they put it on every phone. They activate this feature unaware to anyone including the field reps activating. When I educated one higher up rep who has activated some 300 phone this year he was so worried that he decided to call each customer and let them know they had this international dialing. He felt they were all vulnerable to what happed to me and this guy. This is why Nextel and Cingular got it right, you want this expensive feature you must ask for it. Not only does TMobile not have this policy, they don't even tell you in writing that it's on. thanks again for your words.

GETTING STARTED SECTION 1 PAGE 7


MAKING AND RECEIVING CALLS 2ND SENTENCE

YOU MUST CALL CUSTOMER CARE FROM YOUR T-MOBILE PHONE TO REQUEST INTERNATIONAL DIALING

If this is not their policy, why is it included in the box with the phone when you activate. If this is not their policy please show me any mention of the opposite when you activate either in the box, in the contract or terms and conditions. If you cannot find any mention then this has to be the only conclusion.

Go get your welcome guide or go get one and also check out page 11 it's adds proof to this again.

I never requested international dialing so I have refused to pay international charges.

You're absolutely right about the welcome guide. That would give you even more reason to refuse the charges. Fight it and don't stop until you are vindicated. Like any other huge corporation, T-Mobile is scattered with not-so-intelligent people, as well as very intelligent individuals, try to find the intelligent ones which i know, will be very difficult. Do not worry about your credit report, the credit reporting agencies have ways to dispute negative reports on your credit. If you can't get it resolved through T-Mobile, you might be able to fight it through experian and the other major credit bureaus. At very least, you can include an explanation to any negative item on your report that people will see when you apply for something and have your credit ran.

Thanks for your strong support Mike. I really appreciate this. When I found out about this bill I really had thoughts of suicide. I had some other stuff going on and this was just the last straw. Then I started reading and realising this is a nice scam they got here, write one policy but make it unknown that it's the old policy. You get a huge bill and bam they get you on the phone and tell you Oh no on July 2004 we changed policy all phones have international dialing. But But I activated in 2004 how am I supposed to know. Were does it say that in the contract or the terms and why does yout TMobile welcome guide and web site says you got to order it. Their answer was repeatedly, Sir the policy is now this now pay up or else we ruin your creidt.
And look what happens I told TMobile over and over if you just would make it clear that this is the policy we could have avoided this whole mess. Thanks again I do appreciate your kind words the best to you and your life. In my letter to the FCC I put this as my first line a $12 an hour David vs a $70 Billion dollar goliath. I need your help. Let's see what the FCC comes back with. Otherwise is civil court for this case. I will sue them for the bill for the pain and suffering legal costs and so it. I am ready for the fight now.

I will sue TMobile to get the bill removed or reduced to just domestic calls. I will sue them for my time writing and calling them and for the suffering and anguish I have gone through. I have offered to pay a reasonable rate per minute of 25 cents, that's what I would have paid on gphone which I am a rep for. It would still have been a $1000 bill. Not only is this deceptive and illegal, now they want to make maximum profit on me. At $1.49 per minute, (when Cingular charges 49 cents for the same call) TMobile is making great money on this feature. Bottom line, they put a feature on my phone I did not ask for. I have proved it over and over, when in doubt the customer should always be right. TMobile is wrong in so many ways. I could try them on : deceptive practice - false claims - not abiding to their own policies - cramming - harrassment - I don't know I am just very frustrated with them and You have any ideas? I have gone through so much hell and crap because of their blind policy it has keep me up many nights and I have lost sleep and hours at work and I spent 100 hours writing to the FCC, TMobile's legal dept and executive care, I have made at least 40 calls to them it is so frustrating in all those calls they haven't lowered the bill even 1 single dollar. This is a for profit unannounced policy this international dialing. This for profit policy is hurting many of their customers and it has to stop. For me it has not been easy. thanks

For the guy who started this post and anyone else in this mess go to www.mrdillo.com/tmobile there are 4 pages of printable proof T-Mobile has to legal ground to go after us, but please use this info to help your case against T-Mobile they have a confusing policy and need to fix it for the good of their customers, their field reps and themselves.

I can even sue the company that activated my phone since they didn't tell me about this feature.

True, but by signing your contract at activation you agree to ALL THEIR terms and conditions and if you dont agree it states in the terms and conditions of service that you should not use them.
