samsung, i just wanted to say thanks for finally putting a lid on that mrdillo moron. Its been a while since ive been on the boards (went out and got myself a new job) so its a little late but i still wanted to say thanks.

to say that that guy is an idiot would be a compliment. hopefully the judge will read the contract and see the mandatory arbirtation clause and respond with 2 words: "case dismissed"

I have one week before my court case. I have contacted several top lawyers who see a clear pattern of extorsion and failures on TMobiles part.


I have a letter from the FCC telling me I have the option to go to civil court, besides I never signed the contract I am not bound by it's laws. I tried everything to work things out with them. I had no choice. Even their answers and admission were weak to my civil lawsuit case.

Arbitration was not binding and would have cost me $500 plus other fees.
I am I will keep you posted on my case.

Maybe I'm misunderstanding you, but I have kind of read the thread that discusses your issue, and I'm confused here. If you didn't sign a contract, and that means you have no obligation to follow its rules, doesn't that mean T-Mobile didn't enter into a binding contract either, and therefore also doesn't have any obligation to you? Either there is a contract or there isn't, I would think. Not trying to be combative here, just wondering.

You know I have thought of that too. I dont really know what to expect but I am amending my complaint to add Declaratory judgement which allows the judge to declare the rights and duties of each party and what I will be fighting for. I need to make sure they do not put this on my credit report which once that happens becomes a fight every time I go for a loan or for credit. My credit score is 739 right now.

But if I cannot sue them then maybe they cannot hold me liable for the bill and again my main fight is their welcome said to add inter dialing you have to call it in and they went ahead and added it to me and everyone anyway. That is an excellent point on your part though. Also when their lawyers replied they never brought that up they just brought up personal jurisdiction and weak stuff like that even the court clerk said they all say that. My proof is clear at http://mrdillo.com/tmobile/ their answers are weak at http://mrdillo.com/tmanswers/ I don't know what to expect I haven't the money to really fight them I have offered to work with them but they refused to budge They even lied to me and told me the don't make the welcome guide the phone manufacturer makes it. It's all stupid really if they would just let us know of their policy in their contract and before hand this could have all been avoided. Thanks again.

I won my case. I had civil lawsuit against TMobile for fraud and other charges. My phone bill was over $4733 based on mostly international phone charges. I proved to the courts they did not fully update their contracts and are at fault.

We eneded up coming up with a perfectly fine settlement agreement and I consider this a major win. I showed the courts in simple plain language that TMobile was irresponsible and the terms and conditions smell of fraud or neglect.

I will be paying $350 (the bill was $4733) and I get to start a new 1 year agreement so to xx and the others I won TMobile lost big time. I told everyone that this was TMobiles problem and that them having unclear policy was at fault. WOW what a great day for me. I told you all I would win anyone else needing advice let me know. They didn't have a chance. The judge was really not happy with them.

I figured you would. No comments huh. Nothing to say mr. TMobile insider. All your comments about your going to lose and have to pay their lawyer fees all the other stuff from other people about being a retart and a moron from hockeyman (you didn't punish him did you). I can't beleive it not even congratulations. This forum is so slanted to TMobile it is a shame. TMobile did this to themselves the judge saw it that way too. later

Dude, nobody replies to you because you are stubborn and you dont listen to what anyone else has to say. I'm a Cingular rep and personally I dont care if T-Mobile goes out of business, but it seems to me that you've been pretty petty throughout this whole situation. You even came back to gloat. I really wouldnt be surprised if T-Mobile just gave up and waived the charges.
If they really wanted to take you through court they would have won, its just any Legal fees for a major corporation like T-Mobile are probably gonna cost more than than they would make from charging you that 5000$ bill. Most major corporations usually settle without any sort of major court case, It sounds kinda like you had a Biased Judge... But to tell you the truth, nobody really cares whether you won or not.

actually your wrong I had more than 5 people telling me they are going to throw the book at me and i would have to pay lawyer fees and all kinds of stuff I came here for help initially and all i got was petty insults and no help from tmobile insiders I asked over 40 questions for help got no answers so sorry if you don't see things my way but you don't have to worry you will not be hearing from me. I just can't beleive so many people want a big corporation to win over a regular customer. It's a dam shame.
