The one I bought WAS brand new. Cingular might be selling them for that price, but they usually want a contract extension in return. I haven't been obligated by contract for over a year, and I kind of like it that way.

I have no troube signing contracts with Cingular. Any company that lets me keep my minutes(rollover) is the company I want to go with. I have never ever had any trouble with Cingular. I also have never had trouble with signal quality with Cingular. So if they want me to sign up for a year or two and give me a really great phone for a really great price in return, I don't see the problem. I'm not a coomittment phobe though. I do research, find what's best, and with a clear conscience can sign a contract. Even if I wasn't under contract with Cingular, this will be my fifth year with them anyways. If you do your homework, signing on with a phone carrier that you've researched and found to be agreeable to you can save you tons of money.

Cingular send's you someone's old piece of crap phone. Reconditioned they call it. Slap on a new face plate and walla your new replacement phone. I know because they did it to me. Scratches and dirt on it with a new cover. I made them send me a fresh one right out of the box (new kit) charger,battery and phone and book. Make them get you a new one, why take that crap from them.
If reception is a problem in your area, don't get this phone, get one you can pull the Antenna out of.V551 beware

Dude that is such BS.
I have had six phones from Cingular and not one was perviously used. I asked my friends and family about this (99% of whom are Cinuglar customers), and no one has had this happen. The local shop you bought it from was likely the culprit.
Not only that, but the v551 was the best phone I have ever had, except the new ROKR I just bought.
I suspect this guy's a T Mobile/Nokia plant.......
