Aside from infringement things, which is a better phone...
Where can i find a audiovox unlocked? can't find anywhere (maybe one or two occasionally on Ebay, but don't prefer to buy there)

The phone you're interested in is the same as the Imate SP3i, except the Imate has a joystick instead of buttons. I just bought mine, and had a Blackberry before. Since I don't care about Blackberry's email stuff, I think the Smartphone is a lot better. I've very happy with my SP3i so far, and the form factor is superior.

thank you. what do you mean "email stuff"
ip3 is windows based, right? blackberry is what?
they both have some kind of push system where it notifies you when you have email right? and the sp3i can be unlocked with Tmobile USA right?

If you're looking to unlock an SMT5600, I just did it with this site: http://www.imei-check.co.uk/c500unlock.php
It's $38 but works like a charm (requires Windows 2000 or XP). I got a good deal on the phone, like new in the original box, but it was locked to Cingular. I ran the unlocker program you download as part of the $38 service and I was up and running in about 5 minutes with my T-Mobile service. I still get the Cingular "Welcome" screen on startup but it finds my TMO service right away. I'm sure there is a way to unbrand the phone but I'm not ready for that yet.
