i had an old nokie phone , i purchased a sony phone monday from cingular, this was called a upgrade. well i have not had a phone since monday. they said the conversion went half way thru that is they turned off my old phone and cannot get my new phone to turn on . this would not be a problem just get a new phone right . well the problem is my phone number. i am self employed for 4 years now . that number is on all my buisness calls and advertising for customers to locate me . that is all i have. i have had no customer contact since monday. losing money everyday every hour that goes by and they the tech department just says sorry. i can see i will make no pay check this week. anyone out their hav any suggestions or legal grounds i might could take against cingular. thanks kizzie123

I'm probably guessing you signed up for AT&T Wireless first. And I'm probably guessing you were going through an upgrade. You might want to talk to Cingular's Porting Administration Center to have that reversed and your old device reactivated until your new device comes in.
I can't really say I feel sorry for you, though. You may work for yourself for your living, and while admirable, you're making a mistake: you're relying on an easily lost, easily destroyed piece of high-tech, expensive equipment for your business. You might want to invest into a landline, you know, as an alternative contact.

no i have been with cingular for 7 years , and i chose cell over land phone due to the fact i am out of the shop picking up automobiles, i am a small fry but i make a honest living, i canot afford to pay someone to answer th phone for me and i am sure alot of people use cells for business. hey buts thanks for your input

I'm slightly familiar with the systems that Cingular uses, which is why I asked about the AT&T Wireless--no account suspension or "conversion" is necessary if you're just doing a TDMA to GSM switch. They just up and future date your equipment. Any rep can re-activate your old equipment, it's a matter of putting the ESN into the system and doing the manual activation, and that's relatively easy.
And you're right, a lot of people do use their cell phones for business. There's no problem with it, but it's rather short-sighted to NOT have a contigency, to not have a back-up. There was a time when there were no cell phones and the jobs were no more stationary than yours and yet they still managed. You can go without a secratary, there are call answering services still available. There are still answering machines to attach those phones.
But as far as every legal officiary's concerned, wireless services are not yet considered utilities; they're just luxuries. The FCC's apparently trying to make them consider that, but not 100% of America is covered with a consistent wireless network and chances are never will be--and if you want wireless service to be a public utilities, there's a good chance consistent service is required.
And since this service isn't a utility, and since also your contract does clearly state that Cingular does [url=http://www.cingular.com/download/Cingular Terms of Service.pdf]not guarantee you uninterrupted service or coverage."[/url] Your chance of a court case is minimal. A class-action over the same issue among millions of subscribers, perhaps.

as neek said i too am sorry your having these dificulties, and cing should have no problem reversing it to get you old phone working, but on a leagal stand point it DOES state in your terms and conditions that
cingular is not held resposeable for any lost income due to useing you cellphone as a means of support.
also on a business stand point, its not very business conscious relying soly on a cell phone isnt very smart, you should invest in a landline w/ an aswering machine that way when your phone doesnt work people still have someway to get ahold of you, and you back with them

If you can't get a landline for your business, at least have voice mail put on your existing number that you're using for a business number.

If you have a business you can not rely on a cell...there is no wire attached to it there for there is no guarantee that it will work all of the time...second conversions take you from one system (old att) to another system (Cingular)...in the long run once completed you will be better off.
