your rep gave you accurate information....
consider this tho....
if you do the service upgrade and have your own equipment already... take the free phone that comes with the move... then if you break the phone you have a spare that you can put the sim in

If u have an unlocked phone that is Customer Owned and Maintained, and if u migrate over to cingular u will have to sign a 1 year contract for sure, because they do require some contractual obligation for allowing u to use there service but not one of there phones. If u have a COAM device u will have to upgarde in a store, or as ELMO mentioned u can migrate with a spare free device, but that will require a 2 year contract, so if not interested in signing a 2 year then u will have to at least again sign the 1 year contract with a migration with a COAM device.

there is a no contract option. it does not include the promo of MTM, but if you have your own phone, you don't need to sign a contract.

If u stay attws u dont have to change plans, as long as the phones are unlocked u can stay with attws, but beware of unlocked phones, they are not warrantied, we can't troubleshoot, and u may or may not have issues with TM and Mmode. So the best idea as suggested before is to migrate with free phones from cingular to use as spares if the unlocked phones ever become defective bc again no company that I know of will warranty a unlocked phone, if u go to cingular u will require a rate plan change. And as I mentioned in prior posts, I have been told by cingular customer communication department where I have regular contact with because I am in the Resolutions TIER 1 department that even when migrating or upgrading wtih COAM devices u still have to sign at least a 1 year contract.

All customers activating service with Cingular who sign up on a promotional rate plan and/or take advantage of 1 or 2-yr commitment equipment pricing, are required to accept a 12 or 24-month service agreement.
Promotional rate plans are all rate plans that include unlimited Mobile to Mobile.
Note: Customers who do not sign up for a promotional rate plan AND elect to pay the "no commitment" pricing for the handset or activate with their own equipment, are not required to accept a termed service agreement. (12 or 24 month agreement.) However, they are still required to accept a "No Commitment" service agreement.
These service agreements contain all of the terms and conditions between Cingular Wireless and the customer, including the customer's price plan, terms of payment for service, and any additional services, as well as the terms and conditions of service. The only difference between termed (1, 2 or 3 year) and "No Commitment" service agreements, is that "No Commitment" agreements reflect "No Commitment" for the term of service.
Although the customer is not committed to any specific time frame, they are required to understand our policies and procedures which is covered in the Terms and Conditions.
So I apologize for any misinformation that I have given on previous statements, but be careful that they dont include M2M or N&W as a promotion, bc attws use to require contract extensions for M2M and N&W.
