I ordered my cell phone upgrade (45 months overdue) 3 weeks ago I called them about it a week ago and they told me that it was cancelled.....that is a load of bull since I prepaid it with my credit card rather then have it billed to my account. So they appoligiezed and informed me it would be mailed out that day express mail (2 day) It is now 3 days later. Still no phone. I called Tmobile again only to find out the phone is still not shipped. I was given more empty promises that it will be mailed out on Monday it is now Friday. I asked if I could simply go down to a local store and pick it up.....their response was that would be impossible to do until I have refused delivery of this phone!! How is that possible when it is not even shipped yet!! Also would like to add that the costumer service is HORRIBLE they hung up on me 3 times and refused to get me supervisors. Instead they offered me fax numbers!! How an I going to resolve anything with a fax? Also would like to mention that they renewed my contract for 2 yrs in order for the "upgrade". So basically now I am stuck with horrible service and no phone for 2 years. This can not be legal!! I know if I had this kind of service with my company I would no longer be in business. I just hope that more people will read this and not sign into contract with Tmobile. They do not deserve our money!!

Yeah , First off they should have wiaved your express shipping if you didnt recieve it on time , and second off if u didnt recieve the handset at all or if you had refused the handset they should have reverted your contract

did you change your plan at all or is it just the phone you changed? if it's just the phone, then technically, they have not provided their end of the bargain so you contract should be considered void/null until they've provided their end. which i'm sure you'll have to take up with the bbb.
however, if you changed your plan, they'll argue that that's the service that extended your contract and you'll pretty much be screwed on that. but if you can argue that it's just for the phone, they have to provide you that phone or else there was no exchange for the longer contract.

If you want to find out what happened to your phone you can find out right from UPS. (yeah I know it's probably too late, but in case anyone else has the problem.) Go to ups.com, click on track by reference, enter your ten-digit mobile number with the dashes as your reference number. It will tell you where your package went. As far as the contract, you don't have your damn phone and if you say you want to cancel/get out of it I'm sure a Retention rep will try a little harder to fix your shit, and even if a plan change was done that would only bind you to a one-year contract.

I know that its probably too late for this to matter but just a little piece off info for down the road. You don't have to worry abut the new 2 yr contract you signed. Most companies come with a "Buyer's Remorse Period". Basically what that means is you can cancel the account without termination fees as long as your within that period. NOw i don't know how long the time frame is with Tmobile but with Cingular its 30 days. i know that Cingular has one of the best Buyer's Remorse Period cause it is a month. From what i understand Tmobiles is only 14 days. So in the future if you get dicked around by a company your usually not locked into a contract for several days wich gives you time to bail.
On a side not though i hope you get this all sorted out as i know how truly frustrating that can be for you.

that statement may not be entirely correct..there is a caveat in your terms of service that appears in several sections..."(unless a longer period is required by law)"
I do know that in California the rules are a lot different... there is a buyers remorse period for just about everything there ..the dreaded and still to be ratified (I think) CPUC law ...other states have similar statutes...

I dont doubt your knowledge of company policy one bit..just stating the obvious... your terms and conditions allow for local laws... IE if there is a consumer "cooling off period" law for that state or county.... TMob says it will comply in its TOS......
being a customer care rep myself for quite sometime and haveing read several notations from the legal deprtment on accounts I have come across this more than a couple of times
