So over a year ago I bought a razr motorola from cingular and signed a 2 year contract and paid about 350$ for it. About 5 weeks ago it started to malfunction and I filed an insurance claim to get a new one and paid a 50$ deductibale for it and mailed back the old one.
Three days ago I recieved a new phone for my birthday from my girlfriend and don't need my razr anymore and want to sell it on ebay. One of my friends told me this might go under insurance fraud because I am selling the phone they replaced for me, but considering that I paid for the phone isn't it my property and my decision to do whatever I please with it? and If I do go ahead and sell it, will there be any way of cingular causing problems for the buyer?
Would appreciate some thoughts on this subject.

it is your phone... you do what you want with it...
if you had reported a lost phone and really hadnt lost your phone then placed a claim and sold either the replacement or the phone you reported lost
that would be insurance fraud

it will not cause any problems for the person who buys it. as long as they are a cingular customer or plan on unlocking it, cingular will never know it was the one from insurance. the buyer would beable to activate it like any other phone.

Cingular doesnt track that info... the insurance company does tho

a billion people sell their used phones on ebay, sometimes stolen phones! but mostly used, and they dont get in any trouble
