Unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature constitute sexual harassment when this conduct explicitly or implicitly affects an individual's employment, unreasonably interferes with an individual's work performance, or creates an intimidating, hostile, or offensive work environment.

Sexual harassment can occur in a variety of circumstances, including but not limited to the following:

The victim as well as the harasser may be a woman or a man. The victim does not have to be of the opposite sex.
The harasser can be the victim's supervisor, an agent of the employer, a supervisor in another area, a co-worker, or a non-employee.
The victim does not have to be the person harassed but could be anyone affected by the offensive conduct.
Unlawful sexual harassment may occur without economic injury to or discharge of the victim.
The harasser's conduct must be unwelcome.
It is helpful for the victim to inform the harasser directly that the conduct is unwelcome and must stop. The victim should use any employer complaint mechanism or grievance system available.

When investigating allegations of sexual harassment, EEOC looks at the whole record: the circumstances, such as the nature of the sexual advances, and the context in which the alleged incidents occurred. A determination on the allegations is made from the facts on a case-by-case basis.

Prevention is the best tool to eliminate sexual harassment in the workplace. Employers are encouraged to take steps necessary to prevent sexual harassment from occurring. They should clearly communicate to employees that sexual harassment will not be tolerated. They can do so by providing sexual harassment training to their employees and by establishing an effective complaint or grievance process and taking immediate and appropriate action when an employee complains.

It is also unlawful to retaliate against an individual for opposing employment practices that discriminate based on sex or for filing a discrimination charge, testifying, or participating in any way in an investigation, proceeding, or litigation under Title VII.


I understand that whatever you say might be innocent, but to another it might seem like a sexual advance...it varies on a person to person basis. I talked to a woman the other day, and all I said was "everytime I see you, you keep getting younger and younger". She became really happy and thanked me. A while later, I was confronted by my supervisor of what I had said earlier and warned me that would be construed as sexual harassment. I understood, and apologized...but after that she aked me if I wanted to go out and have dinner. I was like uh...okay, didn't you just complain earlier. I think that people nowadays people have become more cautious of what to say...and just to be safe you have to apologize if someone thought of what you said might be in any way an advancement towards that person. Also, even when it comes being politically correct. Sometimes its hard to tell when you officially offended somone without knowing it. You can't call someone by their ethnic background in slang terms, but it's alright to call someone an idiot. I think being called an idiot [or stupid] is alot more harsh than being called a b*tch, @sshole, or something along those lines.

The big problem is: it is possible to sue (and get by) everybody even if it is the stupiest for thing on earth... the judge will favor the complainant...
(here in Germany once a guy tried to sue the cigarett companies... not for millions, but still a big amount of money... the judge dismissed the case with the words "How stupid are you?")

I guess somebody overheared you conversation and blackmailed you... but beeing blackmailed for such normal phrase is more than stupid...

And many americans still wonder why so many people in the world thing that all americans are stupid...

Next step: every man has his eye to be removed so he can't look at women at work...

that sounds like there is another woman or man that overheard you speaking with this woman maybe it wasn't her that was complaining about sexual harrasment if she asked you out.. ??? seems odd. women can get spiteful liek that somewhere.

I hate having to leash my sense of humor in fear of getting in trouble with Human Resources (a.k.a. the great and powerful OZ). In my call center I can be myself around... maybe 5 people. Especially when the department I work in has some petty, spiteful people who are happy getting people in trouble. And It's not like I'm overly vulgar or B. sexual with my jokes.

People are too PC.

I was calling my command post and stated that my customer was being a ******** and got in big trouble for it because it was someone I didn't know.. if it was one of my regular peoples they wouldn't have done anything but told me they'd wash my mouth out with soap etc.

I agree, people are too PC.

A person is smart, understanding, accepting, and forgiving.

People are irrational, petty, fearful, and unforgiving (I guess that's one of the reasons people have to be PC).

And Jadall, I know what you mean. It's sometimes funny when a woman is mad at you (even though you didn't do anything for her to spite you). They tell you that everything is fine & they act like your best friend. But when you turn your back, the claws come out with knives in hand. And they stab you more times than in the movie Scream. I like it if someone tells me up front if there is something wrong, because at least they're being truthful.

I am a female and yeah I think there is a big difference between harrassment...unwanted advances and good old flirting.....and lets be honest those who don't like to flirt or who get mad when someone flirts with them....should find a big cliff and jummmmmmpppppp!!!!!! LOL icon_devil.gif
