Hello was havin a debate with my coworker. The question was if i find a lost phone (Not a phone I lost) can i use that phone with my account.

Depends if it is reported as lost/stolen. If it is, it will be put on a negative file and you won't be able to activate it.

If he takes it in to Verizon will they mail it back to the right owner?

No they won't. they'll try to contact the owner but they won't mail it back without speaking with them first.

The standard courtesy is to bring it to a corporate store, the store'll contact the customer and ask them to pick them up. Rarely will they mail it out (though once a store in Coloroda sent this man's phone back who was in Rhode Island...)
If you have a lost phone, I'd first call into customer care, ask if this device you found is associated with an active wireless number--even with every security protocol, if you asked "Is this ESN eligible for activation?" should be answerable.
If the original device has been reported lost/stolen, then no, you can't get it activate. If it hasn't been reported and the original user just cut their losses and replaced it, then sure. It's not right to find a lost phone and instantly want to activate it, though. It's someone else's contract, someone else's money that went into that phone.
