Hi everyone. I have a qs that's more related to those customer care guys around here. I am almost out of a 3.5 year contract (family plan, was adding lines at diff. times, that's how it's gotten so ugly). I was thinking about getting the new phones for my family, so I called the customer care - but got nothing besides "we're sorry, but you'll have to switch to a newer plan". They couldn't upgrade my phones even when I told them that I am going to switch to Sprint (it gives me a 23% discount plus gets me new phones).
Is there any way to keep my current plan and upgrade the equipment from Cingular (I know a way through eBay, but don't wanna do it - might not be new, kind of "not free").
Any feedback on this would be appreciated. Thanks.

I'm not a CSR (Customer Service Representative), so please take what I say with a grain of salt.
I hear your frustration - it stinks that AT&T won't upgrade phones within their old wireless service plans. I suspect that there isn't anything you can do to change that; with the merger and the new AT&T Unity plans, I imagine that the company is trying to drop older plans and use the new ones.
Have you considered changing to a new plan? What is keeping you with the older plan - price, features? It may be the case that moving to a new plan won't tie you into a new contract, if that is a concern. I have, on occasion, switched between plans with AT&T and have not had any changes in contract length.
The other option you're considering - buying phones from eBay or other third-party options - is truly a viable one. In fact, that is what I have done for the majority of my phones (I just purchased one recently). Its not as much of a crap-shoot as you may think. Researching the phones and the seller's reputation (the Better Business Bureau now has an online search feature) is more work, but you can oftentimes come out on top with regards to pricing and phone models. If you truly love your current AT&T service plan and don't want to change companies, I would say that this is your best option.

My AT&T Wireless plan: Family Talk - 900mins, nights start at 7pm, free calling on weekends, free M2M, free incoming txt, ims, mms - all for 59.99 plus 3 lines for 9.99 ea.
It's not that this is a problem for me to get the new phones; but I just don't see a good reason for them not to provide 'em to me so I won't switch to a different carrier (I will if they don't). It sounds ridiculous when they wish you "good luck" with a new service
BTW, I'm not frustrated - I have a choice and all I'm trying to do is give them a chance to keep my 4 lines under their service; if they don't wanna do it - hell with it - Hello Sprint, 4G, Google Portal and Goodbye ex-monopoly

If you're not willing to buy unlocked phones through a thrid party then your only recourse to go to another carrier. The window to change old blue AT&T plans has long been closed. Its not a matter of customer service not wanting to help you out, they simply can't. Blue plans cannot be changed in any way.

If I were you, I'd buy unlocked phones (Or GoPhones) to avoid getting all the lines in your family plan on a 2 year agreement. If you go to a more current plan, you'll be easily paying $25 a month more for the same services to get the new phones.
Sam's club had the Moto 168i GoPhone for $26.
I'm not sure if you have old AT+T sim cards, but if you do, they probably won't work in the GoPhone, unless it is unlocked.
If you have the old sim cards, I doubt that Cingular will upgrade your sim card without requiring you to change your plan.
