My boyfriend and I recently moved out of the city. Since then, we've been unhappy with the call quality we've had with our T-Mobile cell phones. Consistently getting fuzzy reception and dropped calls; we would like to move to another carrier with better coverage in our area. Being first time homeowners of a fixer-upper, we can't really afford the poor service when dealing with contractors and whatnot during these vital first few months. People need to be able to reach us, and vice versa.

We thought our contract would end October 7th, 2007, but two seperate calls to T-Mobile CS told us it was December 20, 2007. We never received a hard copy of the contract, and when we asked for them to send us one, they said it's not possible. How are we to know when exactly our contract ends if we don't have a contract? How do we know a contract even exists? Can we be bound to a contract if we have no proof of it's existence? If we were to cancel, would the early termination fees be thrown at us in this situation?

I understand there's only two months left in our supposed contract, but our service is causing more trouble than it's worth. And we don't want to run the risk of Early Termination Fees, as we're unfamiliar with the territory since we've never cancelled before.

Thanks in advance for any and all input and advice.

You would still have an etf up to november 20th. Tmobile has terms within their contracts about agreeing to extensions via phone and not having to physically sign anything. They normally keep a recording on file of you agreeing to this. You could try to ask them to play that recording back to you, which would also contain the date you agreed to the contract.

This is why I have a filing cabinet filled with copies of things I have signed.
