I originally purchased a cell phone and 2yr contract with the original AT&T Wireless, and was paid and current all through the transition to Cingular and back to AT&T again. My contract has now expired, but I've been using and paying for my old plan on a month-to-month basis.
Lately though my old Sony Ericsson phone has been very unreliable and I'd like to get a new phone.
I can expect that if I was going to try to get a phone through AT&T, they'll want to sell me one of their new contracts and that's alright. But I don't find their current plans as appealing as the competition's, and neither the new AT&T nor the competitors out there can beat my old classic AT&T plan I bought four years ago.
I figure I'll just buy a new phone, but was wondering -- with my phone being officially issued by the classic AT&T, can I buy a phone locked by current AT&T and use my old SIM card with it? Or do I need an unlocked phone? I know that despite the name the companies are different, but are they different from that technical perspective?
I'd appreciate any help you guys could give. I've been racking my brain over this one. Thanks.

Yes, you can technically, but more than likely ATT will not be cooperative in unlocking the new phone to use your old ATT wireless sim (remember, different companies here) unless you've had your new device for a minimum of 90 days.
Sorry about your plans, but sadly that is how cell phone business works.

you can pay FULL RETAIL cost for the phone , and with proof of it request the unlock code
