How to get out of unfair Sprint ETF? Not under contract

About 20 months ago I signed up for a Nextel phone under a 1 year contract. I know I was under a one-year contract for several reasons:

1. I went with Nextel over Verizon primarily because they would give me a one year contract, and I made sure I read every piece of paper I signed to make sure I wasn't accidentally signing up for 2 years.

2. I paid more for the phone because I didn't qualify for the 2 year contract discount price.

3. Several months ago Sprint reps called me on 2 different occasions, and I recieved 2 different mailings, trying to get me to "re-up" and recieve $100 credit on my account.

The 1 year contract was a sticking point for me because I was finishing up college. My filing system wasn't the best, and my papers were thrown out by my parents after I got my first apartment.

I ported my number over to AT&T in January. Aside from paying for the entire months service for the 2 days I was still their customer, Sprint is claiming that I was under a 2 year contract and subject to the ETF. After a couple hours on the phone, no argument about the final bill except the ETF, and being transferred around, I was told that I was being referred to a "specialist" that deals with these sorts of issues and I would recieve a written response shortly.

They are claiming that the people that contacted me to get back under contract were doing so "against policy" since I was still under contract, and that they should have only offered me $75 anyways. They also claim that they do not offer 1 year contracts, and so I couldn't have signed up for one.

I signed up in a rural area that was not yet "Sprint" when I signed up; it was Nextel Partners, Inc. It was a 1 year contract, I'm sure, but I no longer have the copy of the contract. What can I do other than claim it to them over and over?

Sprint does not offer one year contracts any longer, haven't for a couple of years now. If you were a previous customer and did not qualify for the two year contract price, but still got a discount on the phone, that was a two year contract you signed. The only way that I can think of to prove that is was a one year contract is to either have a copy of the contract signed, or go to the dealer that you bought it from, and see if they have copies of it. Other then that, I think what actually happened was that you did sign a two year contract, but the dealer was not clear about it. I'd need more details to your situation to offer a better answer.

I signed up with Nextel Partners Inc, before they were Sprint. My phone would have a discount, but I didn't get it because of my 1 year contract.

Sprint wouldn't have solicited me to go back under contract if I still had a year left, but I don't have that proof since it was junkmail and phonecalls. I'm hoping that the store has a copy. I KNOW the papers said one year. I also had the option of no contract with a plan with less features.

When I had problems right after the service started Nextel knew I was one year, and now Sprint claims it was 2. Is there anything I can do?

Actually They Do Offer The 1 Year Contract, But Only To Existing Customers ReSigning

Still the burden of proof that you signed a one year contract is on you, especially when company wide that has not been readily offered in many years.

I found out the local store I bought from screwed me over. They just told me everything I wanted to hear and then turned it in as a two year. I've found out this has happened to others also. I'm just paying it now so they don't turn it in to a collection agency. Sprint Corporate acknowledged they believe me, but without the paperwork I've got nothing. This apparently has happened before. Now I'm just warning people away from this local(independent) shop.

Not only am I out the ETF, but I'm also out the $50 rebate that they said I wasn't eligible for when I bought the phone.

Keep your contracts everyone! I lost it over the course of moving 3 times.

When I got to the higher ups in Sprint in Overland Park KS they were more than willing to help if I were to just send them a fax of the copy I received from the store.

That sucks, I feel for you, I've moved a lot before, and it's so easy to lose things when you move that often. At least Sprint would like to do the right thing for you. I don't want to say bad things about dealers, being one myself, but I don't think all of them have the customers at heart the way I do.

Alot Of Dealers Will Say Anything To Get You Into Contract. Sad Really.

I don't want to say a lot. I would say a few are out for the money only. As a salesperson I won't paint a picture that shows a lot of salespeople as heartless money mongering people. But there are bad eggs among them as there are bad eggs among all professions, because it is not the profession or the people that choose it, but the people who're going to be that way no matter what they do. It still doesn't change the extreme suckage of the situation.
