Can I get an iPhone and give it away without iPhone plan?

A long time ago my phone broke but I couldn't re up my contract. My fiance re up her and got me a HTC Fuze. Well now my chick dropped her phone in water and the mic does not work.
She wants the 8GB refurb iPhone, Can I re up my contract get the phone then give it to her but me keeping my old phone without the iphone plan? After she gets the phone she will get the iphone plan.
We not not on the same contract, like family plan. We each have out own lines.

if you use an Iphone the data plan is a requirement.if it isnt added by you it will be by att in a maitenance sweep.its in the terms of service

Elmo I am going to re up my contract but never activate the iphone under my account. So will I have to have the iPhone plan? I will give the iPhone to my chick and she will activate it. You catch what im saying?
I do not want to be stuck with the iPhone plan if im not going to have it cause I will give it to her.
